Here we indicate the first mandatory elements of the contract, namely : the precise identification of the seller – obligations imposed in particular by article 6 of the LCEN (sanctions 1 year of imprisonment and €75,000 fine in default), article 19 of the LCEN, articles L111-1 and s . of the Consumer Code. PREAMBLE

The Seller is a publisher of gold and silver investment products and services intended for consumers, marketed through its website(https://goldunion.uk). The list and description of the goods and services offered by the Company can be consulted on the aforementioned site.

The company's activity is presented and explained as well as the destination of the products - these obligations are imposed by art. L111-1 consumption code.

Article 1: Objet

These General Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products offered by the Seller. We detail here the object of the contract which is the online sale of products by the Seller

Article 2 : General provisions

These General Conditions of Sale (CGV) apply to all sales of Products, made through the Company's websites which are an integral part of the Contract between the Buyer and the Seller. The T&Cs applicable then are those in force on the date of payment (or the first payment in the event of multiple payments) of the order. The Customer declares to have read all of these General Conditions of Sale, and where applicable the Special Conditions of Sale linked to a product or service, and to accept them without restriction or reservation. The Customer acknowledges that he has received the necessary advice and information to ensure the suitability of the offer to his needs. The Client declares that he is able to legally contract under French laws or validly represent the natural or legal person for whom he is contracting. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

Article 3: Price

The prices of products sold through the websites are indicated in Euros excluding taxes and precisely determined on the Product description pages. They are also indicated in euros, all taxes included (VAT + other possible taxes) on the product order page, and excluding specific shipping costs. For all products shipped outside the European Union and/or DOM-TOM, the price is calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums do not fall within the responsibility of the Seller. They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.). The Seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities. The Company reserves the right to modify its prices at any time for the future. Article 4 : Conclusion of the contract online

The Customer must follow a series of steps specific to each Product offered by the Seller in order to complete their order. However, the steps described below are systematic: – Information on the essential characteristics of the Product – Choice of the Product, where applicable its options and indication of the Customer’s essential data (identification, address, etc.); – Acceptance of these General Conditions of Sale. – Verification of the elements of the order and, if necessary, correction of errors. – Follow-up of payment instructions, and payment of products. – Delivery of products. The Customer will then receive confirmation by email of payment for the order, as well as an acknowledgment of receipt of the order confirming it. He will receive a .pdf copy of these general conditions of sale. For delivered products, this delivery will be made to the address indicated by the Customer. For the purposes of successful completion of the order, and in accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide true identification information. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

Article 5 : Products and services

The essential characteristics of the goods, services and their respective prices are made available to the buyer on the company's websites. The customer certifies having received details of the delivery costs as well as the terms of payment, delivery and execution of the contract. The Seller undertakes to honor the Customer's order within the limits of available Product stocks only. Failing this, the Seller informs the Customer. This contractual information is presented in detail and in French. In accordance with French law, they are subject to a summary and confirmation when the order is validated. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The validity period of the offer of Products as well as their prices is specified on the Company's websites, as well as the minimum duration of the contracts offered when they relate to a continuous or periodic supply of products or services. Except under specific conditions, the rights granted hereunder are only granted to the natural person signing the order (or the person holding the email address provided). In accordance with legal provisions regarding compliance and hidden defects, the Seller refunds or exchanges defective products or products that do not correspond to the order. A minor does not have the right to purchase gold or silver in one's name, it is possible for a parent to purchase precious metals for their children. Upon reaching the age of majority, the sub-account holder becomes full owner of the precious metals ordered.

Article 6 : Reservation of title clause

The products remain the property of the Company until full payment of the price.

Article 7 : Delivery terms

The products are delivered to the delivery address which was indicated when ordering and the time indicated. This deadline does not take into account the order preparation time. When the delivery requires an appointment with the customer, an email will be sent to them to choose their slot. When the customer orders several products at the same time, they may have different delivery times. In the event of late delivery, the customer has the possibility of resolving the contract under the conditions and terms defined in Article L 138-2 of the Consumer Code. Delivery times for orders can vary between 5 and 10 working days. In the event of a delivery delay, customers are notified via their personal space on the site and/or by telephone.

The customer's order is prepared upon receipt of a copy of their identity document on their space or by email at goldunionpro@goldunion.uk.

The Seller provides a telephone contact point (cost of local communication from a landline) indicated in the order confirmation email in order to monitor the order. The seller points out that when the customer takes physical possession of the products, the risk of loss or damage to the products is transferred to him. It is up to the customer to notify the carrier of any reservations about the delivered product.

DESCRIPTION OF DELIVERY TERMS

Article 8 :Availability and presentation

Orders will be processed within the limits of our available stocks or subject to stocks available from our suppliers. If an item is unavailable for a period of more than 4 working days, you will be immediately notified of expected delivery times and the order for this item may be canceled upon simple request. The Customer can then request a credit for the amount of the item or its reimbursement.

MANAGEMENT OF ARTICLE AVAILABILITY

Article 9 : Payment

Payment is due immediately upon ordering, including for pre-ordered products. The Customer may pay by credit card or bank check. Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa). Secure online payment by credit card is carried out by our payment service provider. The information transmitted is encrypted according to the rules of the art and cannot be read during transport on the network. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing their banking information during the sale, the Customer authorizes the Seller to debit their card for the amount relating to the price indicated. The Customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately resolved by operation of law and the order cancelled. Important details regarding payment, the type of cards accepted, checks, etc. 
For all checks lost by the customer and that we are obliged to oppose, an amount of sixteen euros (€16) will be deducted from the new check received for the LK Group and an amount of fifteen euros (€15) for the RL group. This amount of €16 or €15 corresponds to the bank charges related to the opposition of the check when it is lost. For checks whose amount is equal to or less than €16 or €15, the check will not be reissued.

Article 10 : Withdrawal period

Under Article L. 221-28 of the Consumer Code, “the right of withdrawal cannot be exercised for contracts for the supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period”.

Since the price of gold is subject to fluctuations in financial market rates, the Client cannot exercise the right of withdrawal once the orders have been placed on his behalf.

The right to cancel only exists for items whose price is not subject to fluctuations in financial markets (for example "accessories"). In this case, please write to us at goldunionpro@goldunion.uk

Article 11 : Guarantees

In accordance with the law, the Seller assumes two guarantees: of conformity and relating to hidden defects in the products. The Seller reimburses the buyer or exchanges products that are apparently defective or do not correspond to the order placed. The refund request must be made as follows: write an email to goldunionpro@goldunion.fr. The Seller reminds the consumer that: – has a period of 2 years from the delivery of the goods to take action with the Seller – that he can choose between the replacement and the repair of the goods subject to the conditions provided for by the aforementioned provisions apparently defective or do not correspond – that he is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods. – that, except for second-hand goods, this period will be extended to 24 months from March 18, 2016 – that the consumer may also assert the guarantee against hidden defects in the thing sold within the meaning of Article 1641 of the Civil Code and, in this case, he may choose between the resolution of the sale or a reduction in the sale price (provisions of Articles 1644 of the Civil Code). The legal guarantees that the Seller must respect. In particular, see Articles L211-4 et seq. of the Consumer Code, the provisions of Articles 1641 and 1648 of the Civil Code

Article 12 : Complaints

Article 13 : Intellectual Property Rights

The brands, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these T&Cs. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

We would simply like to point out here that the sale does not result in any transfer of IP.

Article 14 : Force majeure

The performance of the seller’s obligations under these terms is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

CLASSIC TYPE CLAUSE

Article 15 : nullity and modification of the contract

If one of the provisions of this contract were to be cancelled, this nullity would not entail the nullity of the other provisions which will remain in force between the parties. Any contractual modification is only valid after a written agreement signed by the parties.

STANDARD CLAUSE FOR MANAGING THE POSSIBLE NULLITY OF THE CONTRACT

Article 16 : Protection des données personnelles

In accordance with the Data Protection Act of 6 January 1978, you have the right to query, access, modify, oppose and rectify your personal data. By adhering to these general terms and conditions of sale, you consent to our collection and use of this data for the performance of this contract. Article 17 : Applicable law

All clauses appearing in these general conditions of sale, as well as all purchase and sale transactions referred to therein, will be subject to French law.

Article 18 : Identity document


The purchase of precious metals requires the provision of a valid identity document (identity card, passport, driving license, residence permit) for each order. If the order is placed in one of our agencies, a copy of your identity document, front and back, must be sent when placing the order. If the order is placed directly on our site, please send us your national identity card by email to the address goldunionpro@goldunion.uk. Your order will be shipped only after receipt of your ID.
We keep our customers' ID information fora period of 6 years.

Indeed, article 298 sexdecies E of the General Tax Code (see section on the application of VAT) requires taxable persons to collect and store (for a minimum period of six years) information allowing the identification of customers concerned by transactions involving investment gold and silver whose amount exceeds €1. This obligation concerns both over-the-counter transactions and public sales.
